Terms of Service

In case of discrepancies between the English and the German version, the German version below prevails.

1. Scope. These Terms of Service apply to all orders placed through the online shop shop.formfollowsmeaning.com, operated by Münzing GbR, Neumagener Str. 24, 13088 Berlin, Germany ("Form Follows Meaning", "we").

2. Conclusion of contract. The presentation of products in the online shop does not constitute a legally binding offer. By completing the checkout process, you place a binding order for the products in your cart. The contract is concluded when we accept the order by sending an order confirmation by email or by dispatching the goods.

3. Prices and payment. All prices are stated in euros and, where applicable, include statutory VAT; shipping costs are shown separately during checkout. Payment is made via the payment methods offered at checkout.

4. Delivery. Delivery is made to the delivery address provided during checkout. Stated delivery times are estimates unless expressly agreed as binding. Some objects are made to order; production times are indicated on the product page.

5. Retention of title. The goods remain our property until payment has been received in full.

6. Right of withdrawal. Consumers have a statutory right of withdrawal. Details are set out in our withdrawal policy, available in this shop.

7. Warranty. Statutory warranty rights apply. Our objects are partly handmade and produced in small series; slight deviations in colour, texture and surface are characteristic of the materials and craftsmanship and do not constitute defects.

8. Liability. We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health. In cases of slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

9. Governing law. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence.

10. Dispute resolution. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Allgemeine Geschäftsbedingungen (deutsche Fassung)

1. Geltungsbereich. Diese AGB gelten für alle Bestellungen über den Onlineshop shop.formfollowsmeaning.com der Münzing GbR, Neumagener Str. 24, 13088 Berlin, Deutschland ("Form Follows Meaning", "wir").

2. Vertragsschluss. Die Darstellung der Produkte im Onlineshop stellt kein rechtlich bindendes Angebot dar. Mit Abschluss des Bestellvorgangs geben Sie eine verbindliche Bestellung der im Warenkorb enthaltenen Produkte ab. Der Vertrag kommt zustande, wenn wir die Bestellung durch eine Auftragsbestätigung per E-Mail oder durch Versand der Ware annehmen.

3. Preise und Zahlung. Alle Preise sind Preise in Euro und enthalten, soweit anwendbar, die gesetzliche Umsatzsteuer; Versandkosten werden im Bestellvorgang gesondert ausgewiesen. Die Zahlung erfolgt über die im Checkout angebotenen Zahlungsarten.

4. Lieferung. Die Lieferung erfolgt an die im Bestellvorgang angegebene Lieferadresse. Angegebene Lieferzeiten sind unverbindlich, soweit nicht ausdrücklich als verbindlich vereinbart. Einige Objekte werden auf Bestellung gefertigt; Fertigungszeiten sind auf der Produktseite angegeben.

5. Eigentumsvorbehalt. Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

6. Widerrufsrecht. Verbrauchern steht ein gesetzliches Widerrufsrecht zu. Einzelheiten ergeben sich aus unserer Widerrufsbelehrung in diesem Shop.

7. Gewährleistung. Es gelten die gesetzlichen Gewährleistungsrechte. Unsere Objekte werden teils von Hand und in kleinen Serien gefertigt; leichte Abweichungen in Farbe, Struktur und Oberfläche sind material- und fertigungsbedingt und stellen keinen Mangel dar.

8. Haftung. Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie für Schäden aus der Verletzung von Leben, Körper oder Gesundheit. Bei leichter Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

9. Anwendbares Recht. Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gegenüber Verbrauchern gilt diese Rechtswahl nur, soweit ihnen dadurch nicht der Schutz zwingender Bestimmungen des Rechts ihres gewöhnlichen Aufenthaltsstaats entzogen wird.

10. Streitbeilegung. Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
